Terms and Conditions


Welcome to MEDplat, an open-source, digital public health platform designed to strengthen primary healthcare delivery, improve population health management, and support government, development agencies, and NGOs. These Terms and Conditions govern your access to and use of the MEDplat platform, including its mobile applications, web applications, backend systems, documentation, and associated services.

By accessing or using MEDplat, you agree to be bound by these Terms.

1. Acceptance of Terms

By using MEDplat, you acknowledge that you have read, understood, and agreed to comply with these Terms. If you disagree, you must not use the Services.

2. Nature of the Platform

MEDplat is an open-source Digital Public Good (DPG). The platform provides configurable modules for RMNCH, NCD, Immunization, Nutrition, Surveillance, and other health programs.

MEDplat is designed to be deployed by governments, NGOs, and implementing agencies in accordance with national policies, legal frameworks, and data governance structures.

3. License and Use Rights

MEDplat is distributed under an open-source license. Users may download, deploy, customize, modify, or redistribute the software as permitted under the governing open-source license.

Any derivative works must comply with the terms of the license.

Restrictions:

Users must not:

  1. Use MEDplat for unlawful, harmful, or malicious purposes.
  2. Decompile or reverse-engineer the platform unless permitted by the open-source license.
  3. Misuse of MEDplat to compromise privacy, security, or system integrity.
4. User Responsibilities

Users deploying MEDplat are responsible for:

  1. Ensuring adequate data protection, security safeguards, and privacy protocols as per national law.
  2. Ensuring compliance with ethical, legal, and regulatory standards.
  3. Ensuring users (health workers, administrators, etc) are trained appropriately.
  4. Managing hosting infrastructure, backups, encryption settings, and access control.
  5. MEDplat developers or contributors are not responsible for misuse or non-compliant deployments.
5. Data Ownership and Protection

MEDplat does not collect data by default; data collection depends on the deployment configuration. All data generated, collected, or stored through an implementation of MEDplat remains the property of the implementing organization (e.g., Government, NGO).

Implementers must ensure adherence to applicable laws, including:

  1. National data protection laws
  2. Health data privacy regulations
  3. Informed consent, where applicable

MEDplat contributors do not access implementation data unless explicitly authorized.

6. Privacy

A separate Privacy Policy governs how user data is handled within a specific implementation.

Implementing organizations must prepare and maintain:

  1. Privacy Policy
  2. Do No Harm Policy
  3. Data Sharing Agreements
  4. Consent forms (if applicable)

MEDplat contributors do not provide warranties regarding compliance with privacy laws in individual deployments.

7. Security

While MEDplat includes recommended security practices (role-based access, encryption capabilities, audit logs, backups), the implementer is responsible for:

  1. Securing hosting environments
  2. Managing user roles & access controls
  3. Maintaining secure configurations
  4. Ensuring regular security audits

MEDplat maintainers may provide guidance but are not liable for security lapses in custom deployments.

8. Service Availability

To the maximum extent permitted by applicable law, MEDplat is provided “as is” without warranties on:

  1. Availability
  2. Uptime
  3. Error-free operation
  4. Support services

Support may be provided separately by implementing partners or developers under a contract or SLA.

9. Updates and Changes

MEDplat may evolve over time through contributions from the community and maintainers. Users are responsible for updating their own deployments. These Terms may be updated periodically; continued use constitutes acceptance of updates.

10. Third-Party Integrations

MEDplat may integrate with:

  1. Government dashboards
  2. HMIS systems
  3. DHIS2
  4. FHIR-compliant solutions
  5. External APIs

Implementers are responsible for ensuring legality, data security, and compliance of third-party integrations.

11. Indemnification

Users agree to indemnify and hold harmless MEDplat maintainers and contributors from any claims, damages, liabilities, or expenses arising from:

  1. Misuse of the platform
  2. Violation of these Terms
  3. Non-compliance with legal or regulatory requirements
  4. Custom code developed by the implementer
12. Intellectual Property

MEDplat source code, documentation, and design elements remain governed by the open-source license. Implementers retain ownership of locally developed customizations unless otherwise stated in their agreements.

13. Termination

Your right to use MEDplat under these Terms may terminate automatically if:

  1. You violate these Terms
  2. You breach the governing open-source license

Upon termination, you must cease all unauthorized use of MEDplat.

14. Compliance With “Do No Harm” Principles

Implementers must ensure:

  1. MEDplat is not used to discriminate, stigmatize, or harm individuals or communities
  2. Sensitive health data is protected from misuse

The platform is used ethically and equitably. A separate “Do No Harm Policy” is recommended and must be adhered to by deployments.

Implementing agencies are responsible for registration with the relevant national Data Protection Authority where required by law.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where MEDplat is deployed. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

User Agreement


This User Agreement governs your use of the MEDplat platform, including its mobile applications, web applications, dashboards, and associated services (collectively, the “Platform”). MEDplat is an open-source digital public good designed to support the delivery, monitoring, and management of primary healthcare services.

By accessing or using MEDplat, you agree to be bound by this Agreement. If you disagree, please do not use the Platform.

1. Definition of Users

“You” or “User” refers to:

  • Government health departments
  • Health workers (e.g., ASHAs, CHWs, ANMs, Nurses, Medical Officers)
  • Program managers and administrators
  • Partner NGOs and development agencies
  • Researchers and authorized stakeholders

Use of the Platform is restricted to authorized users only.

2. Purpose of MEDplat

MEDplat is intended to:

  • Support frontline healthcare service delivery
  • Enable digital data collection, screening, referrals, and follow-ups
  • Strengthen monitoring, reporting, and decision-making
  • Improve outcomes across RMNCH, NCDs, nutrition, immunization, disease surveillance, and other public health verticals

MEDplat is not a medical device and does not replace the need for professional medical judgment.

3. License and Use Rights

MEDplat is provided as an open-source platform. Subject to compliance with this Agreement:

  • You are granted a non-exclusive, non-transferable, revocable license to use MEDplat for lawful public health purposes.
  • You may customize, integrate, and deploy MEDplat in accordance with applicable open-source licenses.
4. User Responsibilities

You agree to:

  • Use MEDplat only for lawful and authorized purposes
  • Ensure accuracy of data entered
  • Maintain confidentiality of login credentials
  • Follow all applicable health data protection and IT laws
  • Avoid misuse, reverse engineering for malicious purposes, or unauthorized access
  • Immediately report any suspected data breach or security incident
5. Data Ownership and Control

All data entered into MEDplat remains the property of the implementing authority (e.g., Government, NGO, or Health Program Owner). MEDplat and its developers do not claim ownership over program or patient data. Data use will comply with the applicable Data Protection Laws of India and relevant host countries, including patient privacy and consent requirements.

The implementing authority shall designate a Data Protection Officer or Grievance Officer as required under applicable law. Users retain the right to escalate unresolved complaints to the relevant national Data Protection Authority, including but not limited to the Data Protection Board of India, European supervisory authorities, or African national regulators.

6. Privacy and Confidentiality

MEDplat follows a privacy-by-design approach.

Personally Identifiable Information (PII) and health records must be:

  • Collected lawfully
  • Accessed only by authorized users
  • Stored securely
  • Shared only with permission and legal basis

Detailed terms are governed by the MEDplat Privacy Policy, which forms an integral part of this Agreement.

7. System Availability and Support

MEDplat is provided on an “as-is” and “as-available” basis.

While reasonable efforts are made to ensure uptime, MEDplat does not guarantee:

  • Uninterrupted service
  • Error-free operation
  • Immediate resolution of defects

Support, hosting, and maintenance are governed by separate implementation or SLA agreements where applicable.

8. Intellectual Property

MEDplat is an open-source digital public good.

Platform code, branding, documentation, and architecture are protected under applicable open-source and intellectual property laws.

You may not remove copyright, attribution, or license notices.

9. Prohibited Activities

You may not:

  • Use MEDplat for illegal, harmful, or unethical purposes
  • Upload false, misleading, or malicious data
  • Attempt to hack, disrupt, or impair the system
  • Use MEDplat for political profiling, commercial data exploitation, or surveillance beyond legal public health needs
10. Limitation of Liability

To the maximum extent permitted by law:

MEDplat and its developers shall not be liable for any direct, indirect, incidental, or consequential damages, including:

  • Data loss
  • Service interruption
  • Clinical decisions made using the platform
  • Programmatic or financial losses

MEDplat is a decision-support tool, not a clinical authority.

11. Termination of Access

Access may be suspended or terminated if:

  • This Agreement is violated
  • Data misuse or unlawful activity is detected
  • Directed by the implementing authority or lawful order

Upon termination, continued data retention and access will be governed by the implementing organization’s data policies. Continued storage, archival, or deletion of personal data following termination shall be governed strictly by the implementing authority’s data retention and legal compliance obligations.

12. Modifications to the Agreement

MEDplat reserves the right to modify this Agreement at any time. Continued use of the Platform after updates constitutes acceptance of the revised Agreement.
